1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer”, “Salon”, “User”, or “you”) and Beauty Drivers, operated by EYETECHYN SOFTWARE YAZILIM LİMİTED ŞİRKETİ (Registered in Turkey, Mersis No: 0383101086400001, Tax No: 3831010864, Address: Kısıklı Mah. Alemdağ Yan Yolu Cad. Aşiyan Apt. No: 17 İç Kapı No: 0 Üsküdar / İstanbul) (“Company”, “Beauty Drivers”, “we”, “us”, or “our”), governing your access to and use of the Beauty Drivers website (beautydrivers.com), applications, AI tools, APIs, and associated services (collectively, the “Service”).

By creating an account, clicking an “I Agree” checkbox, completing a subscription checkout, or otherwise accessing the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are accepting these Terms on behalf of a company, salon, or other legal entity, you represent and warrant that you have the authority to bind that entity.

2. Description of the Service

Beauty Drivers is a multi-tenant cloud-based B2B salon management software tailored for beauty salons, hair salons, nail studios, barbershops, and spas. Key capabilities include:

• Online appointment scheduling and digital calendar management
• Customer recordkeeping, notes, and visit history
• Staff profiles, permissions, commission structures, and performance reports
• Point of sale (POS), services catalog, and retail inventory tracking
• Automated customer reminders via WhatsApp and email (token or tier-based)
• AI-powered salon analysis, chat assistant, and operational optimization tools

We continually enhance the Service. We reserve the right to modify, update, or discontinue features of the Service with reasonable advance notice where practical.

3. Account Registration and Security

To access the Service, you must register for an account by providing accurate, current, and complete business information. You agree to:

• Maintain the confidentiality and security of your account credentials
• Promptly update any changes to your registration or contact details
• Notify us immediately at info@beautydrivers.com upon suspecting any unauthorized access
• Accept responsibility for all activities occurring under your account or credentials

Accounts may not be shared among multiple unaffiliated businesses without prior written consent from Beauty Drivers.

4. Subscriptions, Fees, and Payment Processing

Subscription Plans: Beauty Drivers is offered on a subscription basis under different tiers (e.g., Starter, Professional, Premium) billed either on a monthly or annual recurring cycle, as described on our Pricing page.

Merchant of Record & Payment Processor: Our order process and billing are conducted by our online reseller and Merchant of Record, Paddle.com (Paddle.com Market Limited / Paddle Payments Limited) or other designated secure payment processors. When purchasing via Paddle, Paddle is the Merchant of Record for your order, handles customer payments, issues official tax invoices, and assists with payment-related inquiries and chargebacks in compliance with local jurisdictions.

Taxes: All stated prices exclude value-added tax (VAT), sales tax, goods and services tax (GST), or similar statutory taxes unless explicitly stated otherwise. Applicable taxes are calculated and collected by the Merchant of Record at checkout based on your registered business billing address and tax exemption status (e.g., valid EU VAT ID).

Automatic Renewal: Unless cancelled prior to the end of the applicable billing period, your subscription will automatically renew for subsequent periods of equal duration at the then-current non-promotional price.

5. 30-Day Free Trial

We offer a 30-day free trial on selected subscription plans (including Starter and Professional) to allow salons to evaluate our software risk-free.

• No credit card is required to begin the 30-day trial.
• The free trial includes 25 complimentary WhatsApp notification tokens, subject to standard salon verification to prevent spam abuse.
• At the conclusion of the 30-day period, access to premium features may be suspended unless you select and subscribe to a paid plan.

7. Customer Data and Privacy

Data Ownership:You retain full ownership and intellectual property rights over all salon data, client records, appointment history, and employee information that you input into the Service (“Customer Data”).

Data Processing Role (GDPR): In relation to personal data regarding your salon clients that you upload or collect through the Service, you act as the Data Controller and Beauty Drivers acts as the Data Processor. We process Customer Data solely in accordance with your instructions, our Data Processing Terms, and our Privacy Policy.

Compliance by Customer: You are responsible for ensuring that you have obtained all necessary consents, notices, and legal authority from your salon clients and staff to store their data in Beauty Drivers and to send them automated appointment reminders.

8. Acceptable Use Policy

When using the Service, you agree not to:

• Use the Service for any unlawful, fraudulent, defamatory, or harassing purpose
• Send unsolicited bulk messages, spam, or promotional campaigns that violate WhatsApp Business messaging policies, CAN-SPAM, or telecommunications laws
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service
• Interfere with, disrupt, or place an unreasonable load on our infrastructure, servers, or networks
• Attempt to bypass security measures, authentication systems, or rate-limiting safeguards

Violation of this section may lead to immediate account suspension or termination without notice.

9. Intellectual Property

All rights, title, and interest in and to the Service—including software, UI designs, logos, trademarks, documentation, and underlying AI algorithms—are and will remain the exclusive property of EYETECHYN SOFTWARE YAZILIM LİMİTED ŞİRKETİ (operating as Beauty Drivers) and its licensors. These Terms do not grant you any ownership right to the Service or any Beauty Drivers trademarks.

10. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR UNINTERRUPTED AVAILABILITY.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EYETECHYN SOFTWARE YAZILIM LİMİTED ŞİRKETİ (BEAUTY DRIVERS), ITS DIRECTORS, EMPLOYEES, OR PAYMENT PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY ARISING FROM THESE TERMS SHALL NOT EXCEED THE TOTAL FEES ACTUALLY PAID BY YOU TO BEAUTY DRIVERS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of Turkey (or the statutory jurisdiction designated in the customer order agreement), without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.

12. Modifications to Terms

We reserve the right to revise these Terms from time to time to reflect changes in our Service, legal obligations, or business practices. When changes are made, we will update the “Last updated” date at the top of this page. Material revisions will be notified via email or an in-app notice prior to taking effect. Continued use of the Service following notice constitutes acceptance of the revised Terms.
